These general conditions of sale (referred to below as "GCS") are agreed between:

And any person or organisation visiting or making a purchase via the site: DOUCEUR BRUTE

Placing an order implies that you entirely and unreservedly agree to these general conditions of sale. The GCS may be amended at any time; the GCS are those in force on the site on the date of your order.

These GCS take precedent over all other general or special conditions not specifically agreed by DOUCEUR BRUTE

PRICES and PAYMENTS:

Thes prices shown in the catalogue are prices in euros excluding tax.

The price shown on the product information sheets does not include transport. The price stated in the confirmation of order includes the price of the products, the cost of packaging, the cost of transport and commissioning, and all taxes.

We are a micro enterprise exempt from VAT: VAT DOES NOT APPLY, article 293 B of the Gerale Tax Code.

Douceur Brute reserves the right to alter its prices at any time, but it is understood that the price in the catalogue on the day of the order will be the only one that applies to the purchaser.

Douceur Brute accepts payment of sums due by cheque made out in its name, as a menber of a central accouting group approved by the tax authorities.

ORDERS:

We will confirm all orders by e-mail. All orders, wherever from, are payable in euros.

If all the data is provided and the confirmation recorded, that will be proof of a valid contract.

The confirmation is equivalent to signing and accepting the transaction.

A invoice will be made out and sent ON REQUEST.

If the client changes a measurement, a colour or other detail, after placing the order but before the product leaves the Workshop, and if we give our AGREEMENT: the delivery time will begin again from this new date.

Payment is made in the conditions agreed at the time of the order, unless otherwise agreed between the parties, the balance outstanding must be paid before the products leave the workshop.

DELIVERIES and TRANSPORT in mainland France and Europe:

Deliveries are made to the ground floor by a carrier with a single driver.

Your address must be accessible to lorries.

The carrier cannot give you a precise delivery time (morning or afternoon).

Make sure that you are contactable so that he can warn you if he is late or lost.

.The purchaser is bound by the information given placing the order. The seller is not responsible for being unable to deliver the product if there are mistakes or omissions in the delivery details (full name, number and name of street or locality, floor, postcode, town, telephone number or e-mail address). If this happens, the expense of a second delivery will be payable by the client and invoiced at cost.

Delivery time is given as accurately as possible. Compensation will not be paid for late delivery.

The client is responsible for ensuring that the size of the products is suitable for the particular features of his home (lift, narrow stairs, etc...). If the product bought or ordered will not fit in the client's home because it is too big, or because doors, stairs or lifts are too small, the sale cannot be cancelled. Douceur Brute declines all responsibility and the Client must find his own solution.

Delivery cost will be calculated automatically on site.

The method of delivery differs according to whether the product is bulky or not. Smaller items (lamps, ornaments, sculptures) are delivered by traceable post. For bulky items (tables, standard lamps furniture, second-hand items, made-to-measure etc.) delivery is by carrier.

Once your order has been received and the products FULLY PAID FOR, we will contact you to tell you when it has been dispatched to the carrier's. The carrier will contact you to give you a delivery date.

When you receive your delivery, please check it over before you sign the delivery note.

If the package is not in perfect condition, you should write explicit reservations on the delivery note, stating the apparent damage as clearly as possible, before signing. No claim will be accepted if you have not expressed reservations. You should refuse delivery if the merchandise is damaged, missing, or if the packaging has been opened.

RETURNS:

The purchaser has 7 full days from the delivery of his goods, in which to return them. The items ordered must be returned in initial packaging. The client must pay for the return transport.

Objects that are returned damaged, incomplete, broken or dirty will not be accepted back. The cost will be refunded within 20 days following the receipt of the goods.

There is NO RETURN PERIOD FOR MADE-TO MEASURE items. Under Article L.121.20.2 of the Consumer Code, since the products were made-to-measure according to the client's wishes and specifications, he has no right to cancel his order.

DELIVERY TIMES :

Products on the site are:

1-either in stock (on the site: in stock) with a "nominal" period of 8 to 10 working days from receipt of you payment.

2-or in stock at the shop (on the site: shop stock) with  a delivery time of 15 to 25 days from receipt of your payment.

3-or on order (on the site: with delivery time) require 8 to 16. Special and made-to-measure products require 8 to 16 weeks from the receipt of your payment, depending on stocks of material and the time needed for certain finishes.

TRANSPORT:

THIS SERVICE is payable in full when the product is first presented at the consumer's address, and not refundable if he exercises his right of return. DELIVERY DATES are always for information purposes only. Late delivery is no reason to cancel an order, and does not give any right to compensation.

MISCELLANEOUS:

We try to give you as exact a representation as possible of our products. However, the colour of the object may differ very slightly and we apologise. EACH object or product that we make is the expression of a creative moment and so it has its own history. It is therefore possible that the item delivered to you will be slightly different from the one on our website.

We reserve the right to modify certain parts of our creations.

GUARANTEE:

Articles or products sold are covered by the legal guarantee against hidden defects under articles 1641 et seq.of the Civil Code.

The following are excluded from the guarantee: failure to follow maintenance instructions and advice, abnormal use or use which the product is not intended for (e.g: professional or collective use, etc.) The product under guarantee will be exchanged or repaired, as Douceur Brute chooses.

DISPUTES:

The present contract is subject to French law.

Douceur Brute is not responsible for injury or damage of any kind, material or immaterial, which may result from malfunction or misure of products sold. The same applies if any modifications are made to products. In any event, the responsibility of Douceur Brute will be limited to the amount of the order and cannot be challenger for simple errors or omissions which may exist all the precautions taken in producing the products.

In the event of difficulties, the purchaser has the options, before taking legal action, of seeking an amicable solution with the help of a furnishing trade association, a consumer association or any other adviser of his choice.

You are reminded that in general and subject to the judgement of the courts, the provisions of the present contract relating to the contractual guarantee are dependent on the purchaser honouring his financial commitments to the seller. Claims or complaints will always be given our closest attention, and we will lean over backwards to help anyone who takes the trouble to explain the position respectfully and politely.

In the event of a dispute, the customer should approach our company first, to try to agree a solution.

Failing that, the commercial court in Laval has full jurisdiction, whatever the place of delivery or the method of payment accepted.
